Forensicon Testimony Upheld
Forensicon’s testimony and work has withstood challenges from some of the top 10 law firms in the U.S. and has been upheld by the courts as being fair and balanced, as demonstrated in the Krumwiede vs. Brighton court decision relating to an attack on Forensicon’s neutrality.
Our President, Lee Neubecker was
cited in the case, Liebert Corp. v. Mazur. The appellate
court upheld the testimony and report of Mr. Neubecker in writing a
public opinion pertaining to Forensicon's examination of the electronic
evidence. The published opinion

Another recent notable victory was the Jason Kalish v. Leapfrog Online decision where Forensicon was instrumental in turning a lawsuit by an employee into a countersuit for trade secret misappropriation. Forensicon’s objectivity and Leapfrog Online's request to compel examination of Mr. Kalish's home computer was challenged by Kalish's counsel, but granted by the court. The result of this case was that the parties agreed to dismiss their mutual cases following Forensicon's report to the court pertaining to Mr. Kalish's home computer activities. Simultaneous to the parties dropping their mutual law suits, the original Plaintiff in the case, Mr. Kalish, wrote a check to his former employer, Leapfrog Online, for a significant sum of money.
Forensicon expert's have also served the defense in numerous cases that we are not able to publish on our website due to the lack of a public record on the cases. Some of these cases have included our role in certifying removal of misappropriated information from unauthorized computers, critique of the opposing experts credentials or work product, and various other consulting roles such as assisting our clients in preparation for compliance with the new federal rules enacted December of 2006 regarding electronic discovery.
Our Staff
All of Forensicon’s examiners have received significant training in computers and forensics, and many have significant experience working across related foundational technical and analytical disciplines including: Computer Programming, PC Administration, Network Administration, Network Security, Incident Response, Investigations, Database Management, Data Analysis & Manipulation, Accounting, Statistics, and Electronic Discovery. Our examiners have provided forensic instruction collectively to attorneys, accounting fraud investigators, and law school students. Some of our staff have served as adjunct faculty at the college level for computer forensics programs. Many of our staff also speak to a variety of groups on the intricacies of computer forensics, electronic discovery and the specific practices we focus on, including misappropriation of trade secrets, employment litigation, and internal investigations. Our staff and our work has made Forensicon well known across the nation.
History
The company was founded in 2000 and initially provided technology consulting services to law firms and corporations located throughout the Chicago area. In 2002, the company changed its focus exclusively to computer forensics. At that time, Forensicon expanded into Chicago’s Loop business district, and began adding additional staff. As the company grew, staff expanded to include additional computer forensic examiners, paralegals and litigation support technologists. The continued expansion and growth required Forensicon to move three times within four years to larger and larger spaces in Chicago, until Forensicon opened its current 4,000+ square foot lab in the Chicago Loop business district. In 2005, Forensicon opened its first satellite office in Milwaukee, Wisconsin to serve its customers there with a local presence.
Forensicon has been experts of record on many cases. More than 150 unique engagements within the area of misappropriation related litigation have been worked on by our staff of trained forensic examiners. Some of the more notable cases where Forensicon has been cited have included cases involving the misappropriation of trade secrets, trademark and copyright infringement and counterfeiting, employment litigation, and unfair competition.
