Forensicon concentrates almost exclusively on Intellectual Property matters such as trade secret misappropriation, internal investigations, employment litigation, anti-trust, and unfair competition. Forensicon can begin with an internal investigation prior to possible litigation, and can provide complete support throughout the litigation life cycle.
The company also does a significant amount of work as a neutral third party appointed by the courts to find the truth, or as the agent certifying that one party has removed all property owned by the other party from their computer networks.
Internal Investigations
Forensicon has built its reputation by discreetly investigating current employees suspected of wrong-doing. Our experienced examiners make a forensic copy of the employee’s computer or laptop, as well as networked servers where additional files may have been backed up. Our examiners try to recreate the behavior of the suspect in an attempt to conclusively prove motive and means, as well as detailing any attempts to conceal their actions.
Our reports have helped exonerate the innocent, and our expert testimony at trial has helped prosecute wrongful actions and win or defend civil actions.

There are high-risk industries, such as pharmaceutical, biotechnology, consumer packaged goods, and software development, where their significant research and development investment can easily walk out the front door on a thumb drive attached to a key chain and end up directly in a competitor’s hands. Even with non-compete and confidentiality clauses in employment agreements, these situations are occurring at an alarming rate.
Forensicon can help by providing a forensic copy of critical hard drives on a regular basis, or after an employee leaves to verify what information was there, where it went, and to whom it was sent. If you suspect someone in your organization is stealing trade secrets, Forensicon can forensically copy the suspect’s machine at work, which may provide enough evidence for prosecution, civil action or a compel order for the suspect’s home computer.

Employment Litigation
During an employment litigation case, computer forensics can be the lynch pin in the plaintiff’s or the defendant’s case. Emails, file transfers, and HTML caches are some of the “smoking guns” found during computer forensics investigations that have helped dismiss or settle cases. Some investigations reveal deliberate efforts to hide or destroy information and can lead to claims of spoliation. Willful destruction of electronic evidence often leads to a summary judgment against the offending party along with sanctions including court costs, expert fees and legal fees. Spoliation is a serious matter to the court and is dealt with seriously.
