Forensicon Presents "Electronic Discovery 101" to the American Legal Association
CHICAGO: September 17, 2003 - Forensicon, a computer forensics and electronic discovery firm in Chicago, had the opportunity to present "Electronic Discovery 101" to the Chicago Chapter Small Practice Group of the American Legal Association (ALA) at the conference room in the historic Monadnock building. During the presentation, Lee Neubecker, President and CEO of Forensicon, imparted basic information about electronic discovery to legal administrators who were interested in exploring one of the hottest issues in litigation today.
Neubecker provided a plethora of statistical information that established the worldwide exponential growth of electronic data. He had also mentioned the magnified attention given to electronic evidence discovery after the Enron/Andersen scandal that astounded corporate America. Having established its recent significant role in the legal industry, the presentation went on to explain the more technical nature of electronic discovery in a more understandable language to people who were not inclined to be tech savvy.
The basics of discovery included information that detailed what happens to deleted files (where these files, that most people mistakenly believe are gone for good, reside in the computer), how to comply by rules to protecting evidence and ensuring admissibility, and what to look for in investigations. Neubecker then delved into the more complex nature of computer meta data, which provides essential information about a file, for example, when it was created, altered, and deleted.
Neubecker explained the important steps one must take in order to ensure the admissibility of evidence. He dissected each step to explain the expert's methods in handling the acquisition, authentication, analysis and preservation of the evidence. To guarantee the admissibility of the evidence, the presentation emphasized the importance of complying with electronic discovery regulations and communicated a basic understanding of these to the attendees.
The presentation took an hour, and the Q&A session started immediately after, with Lee Neubecker and Carl Hellner, a Forensicon associate, also a computer forensics expert himself, fielding the questions.
