Forensicon at LegalTech 2003

CHICAGO: October 29-30, 2003 - The legal industry's technology conference, LegalTech, is in Chicago from October 29 to October 30, 2003 at the Sheraton Hotel and Towers. The conference tracks provide up-to-date and insightful coverage of issues that affect litigation today. One of the tracks, Electronic Data Discovery, gains a following due to its popularity in the legal industry right now. One of the presenters, Lee Neubecker, President and CEO of Forensicon, a computer forensics and
electronic discovery firm based in Chicago, utilizes his computer forensics
expertise to provide an explanation on what true electronic discovery is.

Derived from his extensive experience in the field, he is able to field various issues that litigators find helpful, for example, what are effective measures of evidence authentication and how to increase efficiency in finding evidence. Electronic data discovery is one of the hottest issues in litigation today. The explosion of interest is the aftermath of a bad year for giant corporations like Enron, Arthur Andersen and WorldCom. With document production shifting focus from print media to magnetic media (i.e. hard drives, back up tapes, PDAs), electronic discovery has greatly affected litigation processes. The flood of interest in this relatively new industry carved a niche for the discussion on electronic discovery and its various permutations at the conference.

Due to its popularity, it is not surprising that there are many entrepreneurs out there jumping on the bandwagon and aiming to be self-professed "experts" in the field of computer forensics and electronic discovery. However, there is a distinct difference between one who claims to be one and one who is one. Neubecker clarifies:

"A real computer forensics expert has been trained in numerous disciplines, ranging from computer programming, telecommunication networks, business, and the law. To be effective in this field, you must have an innate curiosity and intuition for finding clues and connecting the dots across disparate pieces of information. Many people enter the field and think they are an expert but lack one of these crucial skill sets."

The conference offers three main tracks discussing electronic data discovery: Electronic Data Discovery in the War Room, Electronic Data Discovery in the Courtroom and Staying Ahead with the Next Generation of Electronic Discovery. The topics range from basic explanation of electronic discovery to the more technical aspects of it. The panel also covers the advantages and pitfalls of electronic discovery, as well as how to choose the right computer forensics/electronic discovery service provider.
