Litigation Consulting
Even before a case is initiated, Forensicon can provide investigative services to assist you in determining whether the evidence is there to continue moving forward with your case. We can help you determine whether a third neutral party would be the best strategy for your case. We can also provide expertise in helping you write a definitive motion to compel and discovery requests documents. We can review opposing counsel’s plaintiff and forensic expert affidavits to see whether the forensic evidence substantiates what’s been stated. We can assist in the writing of responses to objections regarding forensic evidence. We’ll be there when you need us, and we promise to respond as quickly as possible to every request.
Chain of Custody
Chain of custody is the process of validating how electronic evidence has been gathered, tracked and protected on its way to a court of law. Because this aspect of computer forensics is so important, Forensicon performs chain of custody services in accordance to the standard procedures accepted at the time in the jurisdiction.
Preservation
Data preservation is done by forensically copying a hard drive. The difference
between conventionally copying a hard drive and a forensic copy is that a
forensic copy is a complete bit-stream copy of the original, including all
unallocated spaces where data may be hiding. Data preservation provides that
upon a lawfully authorized request, based on the facts of a specific case,
particular data that is collected is preserved to prevent its deletion. At a
later point, a request from the court can compel disclosure of that data.
Forensicon can forensically copy a hard drive from any number of laptops,
desktop computers and servers delivered to our office, and we travel on-site as well. Forensicon can handle hostile site acquisitions
as well as arrive after hours for internal investigations.
Analysis
Analysis of forensic evidence is what makes Forensicon different from the rest of the computer forensics providers. Along with using established, industry standard software such as EnCase, FTK and Paraben, analysis involves everything from…
- Password recovery/removal
- Data decryption
- Data compression & imaging
- Media type conversion
- Duplicate file elimination
- Forensic examination of log files and computer registry
- Swap / META file examination
- Website visit logs and internet cache examination
- Email searches
Our experts have case tested methods that have proven Forensicon’s ability to discover as much evidence as possible for our clients.
Expert Testimony and Reports
A number of our Senior Forensic Examiners have filed affidavits and expert reports. They have experience at being deposed by opposing counsel as well as testifying at trial. They have numerous certifications, such as EnCase, Paraben, and CompTIA A+.
One of the examiners was recently cited in the case, Liebert Corp. v. Mazur. The
published opinion of Justice Wolfson, Circuit Court of Cook County, regarding
his testimony can be found at the following link:

Additionally, in the Jason Kalish v. Leapfrog Online, et. al., of the Circuit Court of Cook County, the plaintiff objected to using Forensicon as the computer forensics expert because our experts had been used to investigate the case as part of the defendant’s discovery process: http://www.forensicon.com/docs/Opinion_Kalish.pdf.
As you can see, Forensicon’s experts are known for their expertise, impartiality, and ability to present technical information in a way that juries can understand. Ultimately, that’s what you need in an expert witness and that’s what you get when you call Forensicon.
Data Removal and Certification
Forensicon has occasionally been ordered by the court or requested by adverse
parties to delete electronic property from one party’s networks and to certify its
removal to the court. Typically this includes additional inspections at points six
months and one year from the time of original certification.
Forensicon’s examiners work on-site inspecting all storage devices defined by
the court order, and stay on-site until it is determined all specified data has
been deleted. The certification process satisfies both parties and dismisses the
case.
